These Terms of Use ("Terms") govern your access to and use of westmichiganhiphop.com (the "Platform"), which is owned and operated by Monk Recordings and Art, LLC, a Michigan limited liability company ("West Michigan Hip Hop," "Company," "we," "us," or "our").
By accessing, browsing, creating an account, or using the Platform in any way, you agree to be bound by these Terms and any future updates. If you do not agree, you may not use the Platform.
1. Acceptance of Terms
By using the Platform, you acknowledge that you have read, understood, and agree to these Terms, our Privacy Policy, and any additional guidelines or rules posted on the Platform. Continued use of the Platform after changes are made constitutes acceptance of the updated Terms.
2. Eligibility & Account Requirements
- You must be at least eighteen (18) years old to create an account or use the Platform.
- You agree to provide accurate, current, and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your password and account credentials.
- You are solely responsible for all activity that occurs under your account.
- We reserve the right to refuse service, suspend, or terminate accounts that violate these requirements.
3. User Conduct & Community Rules
West Michigan Hip Hop reserves sole and absolute discretion to determine whether content or conduct violates these Terms, Community Guidelines, or the spirit of the Platform, regardless of whether such conduct is explicitly listed.
We may remove content, restrict visibility, suspend features, or terminate accounts at any time, for any reason, with or without notice, to protect the community and the Platform.
West Michigan Hip Hop is a community platform. By using it, you agree to follow these rules.
3.1 Prohibited Conduct
You may not post, upload, share, or engage in any activity that includes:
- Harassment, threats, abuse, or bullying
- Spam, scams, or deceptive practices
- Illegal activity or content that violates any law
- Hate speech or discriminatory content
- Impersonation or misrepresentation
3.2 Text Profanity (Strictly Prohibited)
Text content may not include profanity or offensive language, including but not limited to: "fuck", "pussy", "dick", "asshole", "fag", "faggot", "nigger", "chink", "clit", "kike", "beaner", "squaw", "dike", "retard", or any word deemed offensive by West Michigan Hip Hop administrators.
3.3 Image Profanity (Strictly Prohibited)
Images may not include:
- Any human nudity, including nipples, buttocks, penis, or vagina
- Any type of gun or firearm
- Blood, gore, or graphic violence
- Any image deemed offensive by West Michigan Hip Hop administrators
Violation of these rules may result in immediate removal of content and/or account termination.
4. User Content
4.1 Ownership
You retain ownership of the content you submit, post, or upload to the Platform ("User Content").
4.2 License to West Michigan Hip Hop
By posting User Content, you grant West Michigan Hip Hop a non-exclusive, royalty-free, worldwide license to use, host, display, reproduce, distribute, and modify your content solely for the purpose of operating, promoting, and improving the Platform.
4.3 Your Responsibilities
You represent and warrant that:
- You own or have the legal right to post the content
- Your content does not infringe on the rights of any third party
- Your content complies with these Terms and all applicable laws
5. Intellectual Property & DMCA
All Platform branding, logos, trademarks, designs, and Company-created content are owned by West Michigan Hip Hop / Monk Recordings and Art, LLC and may not be used without written permission.
Copyright Complaints (DMCA)
If you believe that content on the Platform infringes your copyright, please submit a DMCA notice to:

Your notice must include:
- Identification of the copyrighted work you claim has been infringed
- Identification of the allegedly infringing material and its location on the Platform
- Your name, address, email address, and phone number
- A statement that you have a good‑faith belief that the use is not authorized
- A statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act on their behalf
- Your physical or electronic signature
DMCA Counter‑Notification
If your content was removed due to a DMCA notice and you believe it was removed by mistake or misidentification, you may submit a counter‑notification to the same contact above.
Your counter‑notice must include:
- Identification of the removed content and its prior location
- A statement, under penalty of perjury, that you believe the content was removed due to mistake or misidentification
- Your name, address, phone number, and email address
- A statement consenting to the jurisdiction of the federal courts located in Michigan
- Your physical or electronic signature
Upon receipt of a valid counter‑notice, we may restore the content unless the original complainant files a court action.
6. Privacy Policy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
7. Disclaimers
Content Disclaimer
All content on the Platform is provided by users or third parties. West Michigan Hip Hop does not guarantee accuracy, reliability, or legality of any content. Use content at your own risk.
Service Disclaimer
The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee uninterrupted or error-free service.
No Professional Advice
Content is for informational purposes only and does not constitute legal, financial, medical, or professional advice.
8. Limitation of Liability
To the maximum extent permitted by Michigan and U.S. law, West Michigan Hip Hop and Monk Recordings and Art, LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages.
Total liability, if any, is limited to the greater of:
- The amount paid by you to the Company in the prior 12 months, or
- $50 USD
These limitations are a fundamental part of this agreement.
9. Account Suspension & Termination
We may suspend or terminate your account at any time, with or without notice, if you violate these Terms or engage in conduct harmful to the Platform or its users.
10. Modifications to Terms
We may update these Terms at any time. Users will be notified of material changes via the email address associated with their account. Continued use after updates constitutes acceptance.
11. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Michigan.
Informal Resolution
You agree to first contact us at admin@westmichiganhiphop.com and allow 30 days to resolve disputes informally.
Binding Arbitration & Class Action Waiver
Any dispute not resolved informally shall be resolved by binding arbitration in Michigan, administered by the American Arbitration Association (AAA), on an individual basis only.
You waive any right to participate in a class action.
Exceptions
Small claims court claims and requests for injunctive relief are permitted where allowed by law.
Any claim must be brought within one (1) year of arising.
